Dispute Resolution
Effective Date: September 3, 2025
This Dispute Resolution Policy (“Policy”) is issued by Aquila Private LTD, a company registered in the United Kingdom of Great Britain and Northern Ireland, and applies to all users of the website https://aquila-private.com and the connected platform interface at https://aquila-private.app (“Platform”). It sets out the procedure for resolving disputes that may arise in connection with the use of the Platform, subscriptions, or access to trading strategies.
1. Internal Resolution
Before initiating any formal legal proceedings, you agree to first contact our support team at info@aquila-private.comand attempt to resolve the matter informally. We will review your complaint and respond within a reasonable time frame. Most issues can be resolved without third-party intervention.
2. Mediation and Arbitration
If a dispute cannot be resolved through internal resolution, both parties agree to attempt settlement through informal mediation or arbitration before pursuing litigation. Mediation or arbitration shall be conducted in English and in accordance with internationally recognized dispute resolution practices. The outcome of voluntary mediation is non-binding unless both parties agree otherwise in writing.
3. Governing Jurisdiction
This Policy and all related disputes shall be governed by and construed in accordance with the laws of England and Wales. Any legal action or proceeding shall be submitted to the exclusive jurisdiction of the competent courts of London, United Kingdom. The user agrees not to raise jurisdictional objections in relation to such courts.
4. Class Action Waiver
You agree to resolve any disputes with Aquila Private LTD on an individual basis only. You waive the right to participate in any class, collective, or representative action. All claims must be brought solely in your individual capacity.
5. Limitation Period
Any claim or cause of action arising from the use of the Platform must be submitted within one (1) calendar year from the date the cause of action arose. Claims filed after this period shall be deemed permanently barred.
6. Exceptions
Nothing in this Policy restricts either party from seeking provisional remedies, interim measures, or injunctive relief in a court of competent jurisdiction, or from pursuing enforcement of intellectual property rights.
